Terms and Conditions
JIU-JITSU USA®TERMS AND CONDITIONSEffective Date: January 1, 2026
These Terms and Conditions ("Agreement") govern the use of Jiu-Jitsu USA® ("Academy," "we," "our," or "us"), including participation in training, use of Academy facilities, membership services, and use of our website.
By purchasing a membership, entering the facility, participating in any program, or clicking "I Agree" on any electronic agreement, you acknowledge that you have read, understood, and agree to be legally bound by this Agreement.
1. Membership AgreementMembership provides access to Academy programs subject to the terms outlined herein.Membership fees are automatically billed through the Academy's designated payment processor unless otherwise agreed in writing.Membership remains active until properly cancelled in accordance with this Agreement.Failure to maintain current payments may result in suspension or termination of training privileges without relieving the Member of any financial obligations owed under this Agreement.
2. Payment PolicyMembership dues are due according to the billing schedule selected during enrollment.The Member authorizes recurring electronic payments for all membership fees and applicable charges.Returned payments, declined transactions, or insufficient funds may be subject to additional processing fees.The Academy reserves the right to suspend membership privileges until all outstanding balances have been satisfied.
3. Cancellation PolicyMonth-to-month memberships may be cancelled by providing a minimum of thirty (30) days written notice. Prepaid memberships, including but not limited to six-month and annual memberships, are non-refundable and may not be cancelled prior to the expiration of the membership term except where required by applicable law. No refunds, credits, or prorated reimbursements will be issued for: Missed classes,Vacation, Illness, Injury, Failure to attend training, Relocation, Voluntary withdrawal. The reduced pricing offered for long-term memberships is provided in exchange for the Member's commitment to the full contract term.
4. Chargeback PolicyMembers agree to contact the Academy before disputing any payment with their financial institution. Any improper or fraudulent chargeback initiated without first providing the Academy an opportunity to resolve the matter may result in immediate suspension or termination of membership. The Member agrees to remain responsible for: Original membership charges,Chargeback fees, Bank fees, Collection costs, Administrative expenses, Reasonable attorney's fees where permitted by law
5. Assumption of Risk Brazilian Jiu-Jitsu, No-Gi Grappling, Muay Thai, Mixed Martial Arts, fitness training, and all related activities involve inherent risks that cannot be eliminated.These risks include, but are not limited to:Falls, Joint locks,Chokes,Throws,Strikes,Physical contact, Sprains, Fractures, Concussions, Permanent disability, Death,
The Member voluntarily accepts and assumes all known and unknown risks associated with participation.Participation is entirely voluntary.
6. Liability Waiver and Release To the fullest extent permitted by law, the Member releases, waives, and forever discharges Jiu-Jitsu USA®, its owners, instructors, coaches, employees, volunteers, agents, and affiliates from any and all liability arising from participation in Academy activities except where prohibited by law or resulting from gross negligence or willful misconduct. This release applies to:Training, Open mat sessions, Private lessons, Seminars, Competitions, Demonstrations, Fitness activities, Use of Academy equipment and use of Academy facilities
7. Medical Authorization : The Member certifies that they are physically capable of participating in Academy activities. The Academy strongly recommends consulting a physician before beginning any martial arts or fitness program. In the event of an emergency, the Member authorizes Academy personnel to obtain emergency medical treatment deemed reasonably necessary. The Member accepts full financial responsibility for all medical treatment, transportation, and related expenses.
8. Minor Participants: Participants under eighteen (18) years of age must have this Agreement signed by a parent or legal guardian. The parent or guardian: Accepts all terms contained herein Assumes responsibility for the minor's participation Provides emergency contact information, and Authorizes emergency medical treatment when necessary
9. Academy Rules and Code of Conduct: Members agree to conduct themselves in a respectful, safe, and professional manner at all times. Members shall: Follow all instructor directions, Tap early and immediately and respect all taps. Use appropriate control during training. Report injuries immediately, Wear clean uniforms, Maintain proper hygiene, Keep fingernails and toenails trimmed. Avoid training with contagious illnesses or open wounds. Wear footwear whenever off the training mats. Treat instructors, staff, training partners, and Academy property with respect. The Academy reserves the sole discretion to suspend or terminate membership for conduct including, but not limited to: Harassment, Bullying,Fighting outside normal training, Unsafe behavior Threats, Criminal conduct, Damage to Academy property,No refund shall be issued following disciplinary termination.
10. Competition Participation: Participation in tournaments or competitions is voluntary and involves additional risks beyond normal Academy training. The Member accepts all risks associated with:CompetitionTravelOff-site facilities Refereeing decisions,Opposing competitors. The Academy shall not be liable for injuries or losses occurring during competition events.
11. Media ReleaseThe Member grants Jiu-Jitsu USA® the unrestricted right to photograph, video record, and otherwise capture the Member's likeness during Academy activities. Such media may be used without compensation for: Advertising, Marketing, Social media, Website content, Promotional materials, Educational materials. The Member waives any right to inspect or approve such materials prior to publication.
12. Privacy PolicyThe Academy collects personal information solely for legitimate business purposes including: Membership administration, Billing, Attendance, Emergency contact, Safety records, Personal information is not sold to third parties. Information may be shared only with payment processors, software providers, insurance carriers, legal counsel, or government agencies when legally required.
13. Video SurveillanceFor the safety and security of Members and staff, portions of the Academy are monitored by video surveillance.Cameras are installed in: Training areas, Lobby, Reception, Hallways, Entrance sand Exits. No cameras are installed in:Bathrooms, Locker rooms, Private changing areas. Recordings may be used for:Security, Incident investigations, Injury documentation, Insurance claims, Law enforcement requests, Staff training and Legal proceedings. By entering Academy property, all persons consent to video and audio recording.
14. Responsible Use of Training: Training is intended solely for:Personal development, Physical fitness, Sport, Lawful self-defense. Members agree not to misuse techniques learned at the Academy for: Assault, Criminal activity, Harassment, Intimidation and Unlawful violence. The Academy assumes no responsibility for actions taken outside the facility. Members acknowledge that self-defense laws vary by jurisdiction and agree to comply with all applicable laws.
15. Social Media PolicyMembers are encouraged to share their training experiences responsibly. Members shall not publish content that: Harasses or bullies others,Contains defamatory statements which Includes hate speech or Threatens others. Misrepresents the Academy Members shall not post photographs or videos of minors without parental consent or record private instruction without instructor approval. Violation of this policy may result in disciplinary action, including termination of membership.
16. Website Terms of UseThe Academy website is provided for informational purposes. Users agree not to: Violate applicable laws Interfere with website operation, Attempt unauthorized access, Upload malicious software, Misrepresent affiliation with Jiu-Jitsu USA® Information regarding schedules, pricing, memberships, and promotions is subject to change without notice.
17. Intellectual Property: All Academy logos, trademarks, instructional materials, videos, graphics, photographs, and website content remain the exclusive property of Jiu-Jitsu USA® and may not be reproduced without written permission.
18. Governing Law: This Agreement shall be governed by and interpreted under the laws of the Commonwealth of Massachusetts. Any legal action arising from this Agreement shall be brought exclusively in the state or federal courts located within Massachusetts.
19. Severability If any provision of this Agreement is determined to be unenforceable, the remaining provisions shall remain in full force and effect.
20. Entire AgreementThis Agreement constitutes the entire understanding between the parties regarding membership and participation and supersedes all prior verbal or written agreements.
21. Changes to These Terms: Jiu-Jitsu USA® reserves the right to amend these Terms and Conditions at any time.Updated versions shall become effective upon posting on the Academy website or otherwise providing notice to Members. Continued use of Academy facilities or services constitutes acceptance of the revised Terms.
22. AcknowledgmentBy signing the Liability Waiver, purchasing a membership, or clicking "I Agree," the Member acknowledges that they have carefully read this Agreement, fully understand its contents, and voluntarily agree to be legally bound by its terms.
